The former White House advisor and former Breitbart CEO is likely facing a federal sandwich for defying a subpoena from the U.S. House of Representatives.

The far-right agitator said he would not testify before a House committee investigation the January 6 insurrection. He cites that the former president claiming "executive privilege." 

I believe that former presidents will not be able to claim executive privilege once their out of office. This agitator hasn't been working with the White House since 2018.

The lawyer for the agitator said in a letter that the committee has no intention to testify under oath.

Who hires these lawyers?

Robert Costello, said that Washed Up 45's lawyer Justin Clark had informed the far-right agitator on Wednesday that the former president would be exercising executive privilege and directed the far-right agitator not to produce documents or testify until the matter had been settled.

Rep. Bennie Thompson (D-MS) said that it's coming.

"We will not allow any witness defy a lawful subpoena or attempt to run out the clock, and we will swiftly consider advancing a criminal contempt of Congress referral" 

"Until such time as you reach an agreement with [the former president] or receive a court ruling as to the extent, scope and application of the executive privilege, in order to preserve the claim of executive or other privileges, [the person subpoenaed] will not be producing documents or testifying," said Costello. "[Our client] will revisit his position if [the former president's] position changes or if a court rules on the matter." 

Two former Washed Up 45 allies are slated to appear to the testimony. 

Another ally of the former president was served his subpoena. 

The far-right agitator has until 5pm to show up. His refusal will lead to a federal charge and likely a term until he cooperates with the subpoena. 

The suspect is innocent until proven guilty in a court of law.
