Criminal charges added to Washed Up 45.

Washed Up 45 got more charges thrown on him. Two other men face criminal charges as well. The Special Counsel working this has added additional criminal charges in the classified documents scandal.

The federal indictment, filed in the Southern District of Florida, alleges that Washed Up 45 was part of a scheme to delete security video and that a newly charged defendant — who was identified as a property manager at the former president's Mar-a-Lago residence — told another employee that "the boss" wanted the server deleted.

That employee, Carlos De Oliveira, who was a maintenance supervisor at Mar-a-Lago, was charged Thursday. His lawyer, John Irving, declined to comment.

Court documents say De Oliveira denied that he was involved in moving boxes. "Never saw anything," he told the FBI, according to documents. "Never saw anything," he repeated.

The indictment lays out what federal authorities say was a scheme to obstruct the ongoing investigation. Washed Up 45 was very focused on not allowing officials to get their hands on his boxes, it indicates.

“I don’t want anybody looking, I don’t want anybody looking through my boxes, I really don’t,” The former president told his lawyer in May 2022, according to the indictment. “What happens if we just don’t respond at all or don’t play ball with them? Wouldn’t it be better if we just told them we don’t have anything here?”

Washed Up 45's lawyer said the former president later made a "plucking motion" to suggest that he should take anything that was "really bad" out. Afterward, prosecutors suggest, Washed Up 45 was involved in an effort to delete security camera video that would show how his employees had moved boxes of documents before the FBI search.

The superseding indictment claims that Walt Nauta and De Oliveira met up at a security guard booth where security video was displayed on monitors and that De Oliveira later stepped into an audio closet with another employee and had a conversation that De Oliveira said should be kept between them.

De Oliveira asked the employee how long the server retained video, and the other employee indicated it was about 45 days, according to the indictment. De Oliveira said that "the boss" wanted the server deleted, but the employee responded that he did not believe he would have the right to do that and would need to speak with the supervisor of security, the indictment says.

De Oliveira reiterated that "the boss" wanted it done and asked, "what are we going to do?" according to the indictment.

That conversation took place in late June 2022, just a few weeks before the FBI searched Mar-a-Lago, the indictment says. After the search, it alleges, Nauta called another Washed Up 45 employee and asked about De Oliveira. The unnamed Washed Up 45 employee told Nauta that De Oliveira was loyal and would not do anything to affect his relationship with the former president, according to the indictment.

Nauta later wrote in a Signal chat with the representative of a Washed Up 45 PAC that De Oliveira was loyal, and the former president later called De Oliveira and told the maintenance worker that the former president would get him a lawyer, the indictment says.

Washed Up 45 blasted the Department of Justice in an interview with Fox News after the indictment was announced, calling the charges "ridiculous" and accusing the department of "prosecutorial misconduct."

“It’s election interference at the highest level,” said Washed Up 45, who leads the GOP field in polls on the 2024 presidential race. “They’re harassing my company, they’re harassing my family and by far, least importantly of all, they’re harassing me.” 

The former president and Nauta have pleaded not guilty, and a trial has been set for May.

The suspects are innocent until proven guilty in a court of law.

Wisconsin woman will be getting LIFE in the iron college.

The woman who sexually assaulted and dismembered a man is convicted in Wisconsin.

During her preliminary trial, the killer assaulted her attorney and had to be wrestled to the ground by sheriff's deputies. The charges were added to the conviction.

The Brown County jury deliberated less than an hour before convicting Taylor Schabusiness, 25, of homicide, third-degree sexual abuse and mutilating a corpse in the February 2022 killing of Shad Thyrion, 24, news outlets reported.

Authorities say she strangled Thyrion at the Green Bay home he shared with his mother, sexually abused him and dismembered his body, leaving parts of it throughout the house and in a vehicle.

In his closing argument, Brown County District Attorney David Lasee called the case “bizarre.”

The Circleville, Ohio Police Department has fired Ryan Speakman, the officer who released his dog on a suspect who was being detained by the Ohio State Highway Patrol.

The OSP and Circleville Police were pointing fingers at one another after a police pursuit led to a suspect being injured by the K9.

Jadarrius Rose of Memphis, Tennessee was the 23 year old driver who led the OSP on a chase on U.S. Highway 35 and U.S. Highway 23 near Chillicothe. A Motor Carrier Enforcement was attempting to pull over rose for a missing mud flap when all this drama occurred. Speakman's actions will lead to a hefty civil rights lawsuit and a new standard to police handlers.

The department reacted swiftly.

"Officer Speakman did not meet the standards and expectations we hold for our police officers. Officer Speakman has been terminated from the department, effective immediately," the statement said.

Speakman could not immediately be reached for comment Wednesday afternoon.

The Ohio Patrolmen’s Benevolent Association said on Facebook that Speakman had been terminated without just cause and that the union's senior counsel had filed a grievance.

Speakman was fired “contrary to mandatory principles of progressive discipline,” the union said.

The police department's Use of Force Review Board determined the canine policy was followed during the apprehension and the arrest, the statement said.

Police added: "It’s important to understand that the Review Board is charged only with determining whether an employee’s actions in the use of force incident were within department policies and procedures. The Review Board does not have the authority to recommend discipline."

"We know the video of the incident is upsetting and has attracted widespread attention and comments, including Gov. Mike DeWine raising the issue of training," police said, adding that the department's dogs and officers are trained to Ohio Peace Officer Training Commission-recognized standards.

"In short, we meet or exceed all current Ohio laws and standards for police training for our canine teams."

Rose was driving a semi-tractor trailer when a Motor Carrier Enforcement inspector with the State Highway Patrol tried to stop him because the trailer “was missing a left rear mud flap,” according to an incident report.

Circleville Police and Ohio State Patrol both face heat for minor infraction chase that led to a man being attacked by a police dog.

Troopers used tire-deflating devices called stop sticks twice before his vehicle stopped.

Rose told a trooper who was commanding him to get out of his vehicle that he was on the phone with 911, the incident report said.

A 911 caller who appeared to be Rose told a dispatcher that he feared officers would kill him.

During a second call to 911, a caller was advised to roll down a window, according to audio from the call. “I did that the last time and all of them had their guns pointed at me. You think I feel safe?” the caller said.

The driver was ordered several times to get out of the vehicle and eventually did, and he did not comply when he was told to "get down on the ground," the incident report says.

In video released by the highway patrol, Rose is seen in front of troopers with his hands in the air.

A Circleville police officer with a dog can be heard telling Rose to “go on the ground or you’re gonna get bit.” Meanwhile, a highway patrol trooper instructs Rose to “come to me.”

“Do not release the dog with his hands up!” a trooper is heard yelling multiple times before the dog is released.

Rose drops to his knees as the dog comes toward him and appears to be bitten by the animal.

“Get it off!” Rose repeatedly screams.

“Get the dog off of him!” a trooper yells.

Rose was charged with failure to comply with an order or signal of a police officer, a fourth-degree felony, according to the highway patrol, and could face six to 18 months in prison. He was arraigned and is free on bond.

The White House called the video tragic and disturbing Wednesday.

"Our hearts go out to Jadarrius Rose and his loved ones. ... The president has been clear about the urgent need for Congress to pass the George Floyd Justice in Policing Act to strengthen public safety by promoting accountability and increasing trust between law enforcement and the communities they serve," said Robyn Patterson, an assistant press secretary.

Irish singer and activist Sinead O'Connor has died.

Irish singer, activist and writer Sinead O'Connor (known also as Shuhada) has passed away at the age of 56. It comes shortly after her son, Shane, 17 had passed away.

It appears the singer may have committed suicide.

“It is with great sadness that we announce the passing of our beloved Sinéad. Her family and friends are devastated and have requested privacy at this very difficult time,” O’Connor’s family said in a statement to The Irish Times and the BBC. A cause of death was not given.

O’Connor, who courted controversy throughout her long career, rose to fame with her 1990 rendition of the Prince song “Nothing Compares 2 U,” which hit No. 1 on the Billboard Hot 100 that year. 

Shane O’Connor, died of an apparent suicide last year. She announced his passing in January 2022.  

In her lengthy career, she released 10 studio albums, kicking off with her 1987 alternative rock debut, “The Lion and the Cobra.”

O'Connor, who was born in Dublin, made as many headlines for her activism and provocations as she did for her music.

In 1991 she said she would boycott the Grammy awards, claiming the Recording Academy awarded artists based on commercial success.  

In October 1992, she infamously tore up a photo of Pope John Paul II and said "Fight the real enemy" as she performed as a musical guest on “Saturday Night Live.” She said the move was in protest of child sexual abuse in the Catholic Church.

The move was met with an onslaught of high-profile criticism, with actor Joe Pesci threatening to smack her in his “Saturday Night Live” monologue and Madonna mocking her on the same stage by ripping up a photo of Long Island sex offender Joey Buttafuoco, saying, "Fight the real enemy." Frank Sinatra went as far as to call her “one stupid broad." The move was also criticized by the Anti-Defamation League.

“I’m not sorry I did it. It was brilliant,” O’Connor told The New York Times in 2021. “But it was very traumatizing.”

Even though she declared that she was not a mainstream pop star, she was nominated for several Grammys and won for best alternative music performance for “I Do Not Want What I Haven’t Got” in 1991.

For much of her career, she spoke candidly and openly about her spiritual life, political views and struggles with mental health, which she detailed in her 2021 memoir, “Rememberings.” 

In 2018, O'Connor converted to Islam and changed her name to Shuhada.

“This is to announce that I am proud to have become a Muslim,” she wrote on Twitter on October 2018. “This is the natural conclusion of any intelligent theologian’s journey. All scripture study leads to Islam. Which makes all other scriptures redundant.”

The prime minister of Ireland, Leo Varadkar, tweeted Wednesday: “Really sorry to hear of the passing of Sinéad O’Connor. Her music was loved around the world and her talent was unmatched and beyond compare. Condolences to her family, her friends and all who loved her music."

Tributes and condolences poured in from across the spectrum of public figures.

Irish MMA champion Connor McGregor tweeted that the "world has lost an artist with the voice of an Angel."

"Ireland has lost an iconic voice and one of our absolute finest, by a long shot," McGregor said. "And I have lost a friend. Sinead’s music will live on and continue to inspire! Rest In Peace, Sinead you are home with your son I am sure."

American hip-hop icon and actor Ice T also praised O'Connor. "Respect to Sinead….. She stood for something… Unlike most people…. Rest Easy," he tweeted.

Canadian professional wrestler and WWE star Sami Zayn said "a chill ran through my body reading that Sinéad O’Connor has passed away."

"She dealt with a lot. I don’t know why but I always felt a strong connection to her. Very, very sad. RIP Shuhada," Zayn tweeted.

The American and Scottish rock band Garbage wrote, "This disgusting world broke her and kept on breaking her."

"Godspeed dear fragile dove," the band wrote on Instagram. "Thank you for all the beauty and all the wise teachings you offered up to us."

Gutfeld, a Libertarian media agitator who is a panelist at The Five has a program on at 10pm with a variety of far-right media agitators and unfunny comedians. He was originally at 11pm but the Fox switch gave him the spot that Laura Ingraham once occupied.

Over 20 years of the most stalest media personality in the country.

Gutfeld is a 5'5'' loser. He ain't funny. I seen more funny comedians on the far right. Tim Allen, Alfonzo "Zo" Rachel and even Terrence K. Williams are funnier than this fool.

Gutfeld thought he could joke about how Republicans want to rewrite history to please their white extremist base. It is not funny.

During an exchange with Jessica Tarlov, a co-host who equated the new history standards to saying Jews derived some benefit from being imprisoned during the Holocaust, Gutfeld asked her about the work of Viktor Frankl, a Jewish psychiatrist who wrote about his struggle for survival at Auschwitz and other Nazi camps.

“Did you ever read ‘Man’s Search for Meaning’?” Gutfeld said. “Vik Frankl talks about how you had to survive in a concentration camp by having skills. You had to be useful. Utility. Utility kept you alive.”

Tarlov did not address Gutfeld’s question directly, instead saying she was concerned about middle school children being taught what Florida had set in its new curriculum.

A White House spokesman, Andrew Bates, released a statement on Tuesday condemning Fox News for broadcasting Gutfeld’s comments, calling them “a horrid, dangerous, extreme lie that insults the memory of the millions of Americans who suffered from the evil of enslavement.” He added, “There was nothing good about slavery; there was nothing good about the Holocaust.”

Fox News has not commented on Gutfeld’s statement.

McConnell Frozen Face Sparks Health Concerns!

Sen. John Fetterman (D-PA) had a stroke shortly after he won the Democratic nomination for the Pennsylvania senate race. Washed Up 45, Mehmet Oz, Fox and Republicans were driving this notion that Fetterman is a vegetable and incapable of performing his duties as a senator.

Senate Minority Leader Mitch McConnell (R-KY), 81 freezes during one of his daily rants about President Joe Biden and Democrats. The president calls him and asks if he is doing okay.

McConnell had been making his opening remarks about an annual defense policy bill when he stopped talking. He was silent for 19 seconds. His Republican colleagues asked whether he was OK, and a top McConnell deputy, Sen. John Barrasso of Wyoming, a physician, escorted McConnell away from the cameras and reporters.

Republican Sen. Joni Ernst of Iowa made a hand gesture that initially appeared to resemble the sign of the cross. Her office later clarified that she was motioning for Senate Minority Whip John Thune of South Dakota.

A few minutes later, McConnell walked back to the news conference by himself. Asked about his health, he said he was fine. Asked whether he is fully able to do his job, he said, "Yeah."

Asked about the episode, an aide pointed to McConnell’s saying, “I’m fine,” but the aide added that McConnell “felt lightheaded and stepped away for a moment.”

"He came back to handle Q&A, which as everyone observed was sharp," the aide said.

McConnell spoke to reporters briefly Wednesday night as he left the Capitol and said, "The president called to check on me."

"I told him I got sandbagged," he joked.

A White House official and a spokesperson for the senator confirmed that President Joe Biden and McConnell spoke by phone Wednesday.

Asked by reporters how he was feeling, McConnell said, "I'm fine." He did not directly answer what happened earlier in the day or whether he saw a doctor.

McConnell tripped and fell March 8 after an event for the Senate Leadership Fund — a Republican super PAC aligned with McConnell and GOP leadership — at the Waldorf Astoria in Washington. He was hospitalized with a concussion and a minor rib fracture and was discharged March 13 before he entered rehab.

He didn't return to the Senate, however, until mid-April.

McConnell would never wish Biden well nor any Democratic senator. Biden, who was treated like shit does a honorable thing. 

McConnell treats Biden and his old boss Barack Obama with no ounce of respect. He and the 48 Republican senators are blocking his nominees, voting against bipartisan legislation and literally trying to excuse Washed Up 45's actions.

Bronny James Off The Court!

Lebron James' son Bronny James had experienced cardiac arrest while on the basketball court. The family released a statement saying that he is in stable condition. 

Buffalo Bills player Damar Hamlin offered support to James.

“Yesterday while practicing Bronny James suffered a cardiac arrest. Medical staff was able to treat Bronny and take him to the hospital," according to a family statement.

"He is now in stable condition and no longer in ICU. We ask for respect and privacy for the James family and we will update media when there is more information. LeBron and Savannah wish to publicly send their deepest thanks and appreciation to the USC medical and athletic staff for their incredible work and dedication to the safety of their athletes.”

Bronny James, 18, announced earlier this year that he plans to play basketball at the University of Southern California, where the medical emergency unfolded.

The Los Angeles Fire Department responded to a medical emergency in the 3400 block of South Figueroa Street at 9:26 a.m. PT on Monday and took an adult male to the hospital, a department spokesperson said.

The Galen Center, the home arena of USC basketball, is at 3400. S. Figueroa St.

The 6-foot-3 James was a McDonald’s All-American and was one of the nation’s most heralded players coming out of Sierra Canyon School in Los Angeles.

His commitment to USC was covered by national media and LeBron James, 38, has said he hopes to stay in the NBA long enough to share the pro hardwood with his oldest son.

The heart health of athletes has always been a concern in the world of sports, but has been the focus of several high profile incidents recently.

Cartier Woods, an 18-year-old high school basketball player from Detroit, died earlier this year suffering cardiac arrest during a game.

Buffalo Bills safety Damar Hamlin collapsed on the field during his team's nationally televised game against the Cincinnati Bengals on Jan. 2.

And perhaps the most famous on-court death unfolded in Los Angeles, when Loyola Marymount's Hank Gathers collapsed during a game in 1990.

Ohio State Patrol And Circleville Police Point Fingers At Man Bitten By Police Dog!

The moment you realize you fucked up.

An event that happened in July has the Ohio State Highway Patrol and Circleville Police under fire. The two agencies are blaming one another for the incident that had a suspect injured by a police dog. The suspect was driving a semi truck on U.S. Route 23 when a trooper spotted him. The trooper was going to engage in a pull over over a missing mud flap.

So the trooper tried to pull him over but the driver did not stop. So it led to a chase.

The driver was on the phone with 911 as well. The chase lasted 30 minutes and ended near Circleville.

When the chase ended, the trooper and assistance ordered him out the vehicle. The driver exited the vehicle and followed the directions. Soon the Circleville Police arrived and an officer with a K9 appeared. The Circleville Police have orders and warned that the suspect was going to get bitten if he did not comply. 

So two conflicting orders and it led to the officer releasing the dog and the man getting bit multiple times. He was treated at a Columbus hospital and released to the custody of the Pickaway County sheriff. He was placed in custody for failure to stop, resisting arrest and failure to comply.

The suspect is innocent until proven guilty in a court of law.

Jadarrius Rose, 23 appeared to tell 911 dispatchers in at least two calls that he didn't know why he was being pulled over or why troopers had their guns drawn.

“Right now I’m being chased by like 20 police officers and they all got their guns pointed directly to my truck,” a man police believed to be Jadarrius Rose told a Pickaway County dispatcher during a 2-minute call released Monday. “So now I’m trying to figure out why they got their guns all pointed to me and they’re all white people.”

Rose was pulled over July 4 in Circleville, Ohio, because the semi-truck he was driving “was missing a left rear mud flap,” according to an incident report from the Ohio State Highway Patrol.

Following a pursuit, Rose stood outside his vehicle with his hands raised when a Circleville police officer instructed his dog to attack. A trooper with the Ohio State Highway Patrol could be heard in a body camera video advising against releasing the dog because Rose had surrendered.

The 911 caller, who didn't identify himself but is believed to be Rose, also says that the troopers "exploded" the tires on his truck, which he was driving to a delivery point. (He was referring to tire-deflating devices called "stop sticks" that troopers deployed in an attempt to stop Rose's truck.)

"And it's not even my truck, I'm just driving to my delivery point," he said. "All of them got their guns pointed directly to me."

When asked for a second 911 call Rose made to Ross County, a spokesperson provided audio in which the caller says: "I don’t know why they’re trying to kill me."

Unarmed man was bitten by a police dog after two agencies gave two different orders.

"I do not feel safe with stopping, I don’t know why they’re throwing stuff on the ground trying to get me in an accident," the caller said.

On the 911 call with Pickaway County, the dispatcher advised: "Listen to what the officers are telling you."

"They ain't told me nothing, they ain't told me nothing," the caller said. "I don't know why they're pulling me over."

The dispatcher tells the caller to roll down his window.

"I did that the last time and all of them had their guns pointed at me. You think I feel safe?" the caller said.

The caller is then instructed to put both hands out the window, then open his door with his left hand showing. The call ends shortly after.

Rose was traveling westbound on U.S. Route 35 when a Motor Carrier Enforcement inspector and troopers with the Ohio State Highway Patrol tried to pull him over. When Rose failed to stop, troopers deployed the stop sticks on his vehicle twice before it came to a stop on U.S. Route 23.

After he was ordered several times to get out of the vehicle, Rose can be seen on the body camera video standing in front of troopers with his hands in the air.

Circleville police officer, identified as “R. Speakman,” deploys his K9 and instructs the dog to attack Rose.

“Do not release the dog with his hands up!” a trooper can be heard yelling multiple times before Speakman releases the dog.

The bodycam video then appears to show the dog biting and pulling Rose by his arm as he screams loudly.

Although Circleville police vehicles have dashboard cameras and officers are meant to wear body cameras, Circleville Mayor McIlroy said he does not know if Speakman had one on during the incident.

Speakman was placed on paid administrative leave around five days ago, McIlroy told NBC News.

When asked why Speakman wasn’t immediately placed on leave following the incident, McIlroy said, “I cannot answer that question.”

“Nothing like this should ever happen to anybody. ... It’s just a very unfortunate situation,” he said.

This isn't the first time Speakman's conduct has been under review, according to McIlroy. The officer was investigated in connection with another incident approximately within the past two years.

A use of force review board is reviewing the incident, according to the Circleville Police Department. The board’s findings will be released next week.

McIlroy said he understood how people could be concerned about race factoring into the officer’s actions but adds “… we do not have any racial problems here in the city of Circleville.”

He called the community “all inclusive" and "a great place to live, a great place to raise your family, a great place to send your kids to school.”

Carlee Russell admits it was a hoax.

Let me clear: I will continue to spotlight missing women of color. Over 100,000 Black women and Black children go missing in the United States. The junk food media does not place a spotlight on the missing people of color. Thanks to Black Twitter, America woke up to the news of this missing Alabama woman.

And now Black Twitter will tear her apart after it was confirmed by the woman's lawyer, she made the whole thing up.

The Jefferson County, Alabama prosecutor has not commented on the pending charges Carlee Russell is about to face but she likely will get handed some. 

She is the female "Jussie Smollett."

It did not take long for coon officer Candace Owens to chime in.

Hoover Police Chief Nicholas Derzi raised several red flags regarding Russell's account, and said that police could not yet verify Russell's story. Police also said that Russell had made several internet searches related to Amber Alerts, among other topics, in the hours leading up to her disappearance.

Hours after a lawyer representing Russell revealed the 25-year-old Alabama woman was not kidnapped as she reported to police, her now-ex boyfriend posted a statement condemning her actions.

Russell was missing for two days before reappearing in Hoover, Alabama, and telling law enforcement she had been kidnapped July 15.

By July 19, police said they had been “unable to verify” statements Russell had made about her alleged kidnapping.

In a statement shared Monday, Russell’s now-ex-boyfriend Thomar Latrell Simmons condemned her actions. Simmons had previously spoken to media and posted online about being Russell’s boyfriend before her lawyer said her kidnapping was a hoax.

In his post on late July 24, he called the nursing student his “ex” and said she had created “hurt, confusion and dishonesty.”

“I was made aware of the false narrative after coming to the defense of my ex Carlee Russell,” he said in the statement. “Myself and my family’s nature was to react in love, and genuine concern. We are disgusted from the outcome of this entire situation. I strongly feel exactly like you all. blindsided with Carlee’s actions.”

He added that it’s “still an ongoing investigation” but with Russell’s “confession now we gain closure with this situation.”

He concluded by thanking followers for their support and asked that people “continue to keep us in your prayers.”

In a statement read by police on July 24, Russell’s lawyer said she apologized to the community and everyone who had searched for her.

“As for her friends and family, we ask for your prayers for Carlee as she addresses her issues and attempts to move forward, understanding that she made a mistake in this matter. Carlee, again, asks for your forgiveness and prayers,” the statement concluded.

MAGA Believe Racism Against Whites Is A Threat!

With Americans being polarized by what they see in the junk food media, many of those who voted with Washed Up 45 believe that racism does not exist. They actually think that the Kia Boyz breaking into cars, immigrants coming into the U.S., President Joe Biden appointing people of color to the federal courts, The Little Mermaid, Barbie and movies that replace white protagonists are threats.

Washed Up 45 carried the white vote hands down.

Yahoo News/YouGov polling states that white voters are very concerned about racism towards them. 

The survey of 1,638 U.S. adults, which was conducted from July 13-17, shows that among 2020 Washed Up 45 voters, 62% say that racism against Black Americans is a problem today — while 73% say that racism against white Americans is a problem.

Asked how much of a problem racism currently is, just 19% of the former president's voters describe racism against Black Americans as a “big problem.” Twice as many (37%) say racism against white Americans is a big problem.

Washed Up 45voters and self-identified Republicans — overlapping but not identical cohorts — are the only demographic groups identified by Yahoo News and YouGov who are more likely to say racism against white Americans is a problem than to say the same about racism against Black Americans. A majority (51%) of white Americans, for instance, think racism against people who look like them is a problem — but overall, far more white Americans (72%) say racism against Black Americans is a problem.

Alabama defies SCOTUS decision.
The Supreme Court ruled that Alabama made an illegal gerrymandered map and they must redraw the map to include an additional Black congressional district.

Mississippi, Louisiana, Georgia, Ohio, Illinois, New York, Texas, North Carolina and South Carolina will have to redraw their Congressional districts as well. 

Alabama is defying the ruling. Expect other states to follow.

Alabama governor Kay Ivey approves political map that refuses to create 2nd majority-Black congressional district.

Alabama lawmakers on Friday approved new district lines six weeks after the surprise U.S. Supreme Court ruling upholding a lower court ruling that the state’s previous map — with one Black-majority district out of seven in a state that is 27% Black — likely violated the Voting Rights Act by diluting the voting power of Black residents.

The state’s Republican legislative supermajority boosted the percentage of Black voters in the majority-white 2nd Congressional District, now represented by Republican Rep. Barry Moore, from about 31% to almost 40%. The plan also dropped the Black voting-age population in the state’s sole majority Black district, now represented by Democratic Rep. Terri Sewell, to 50.65%.

A group of voters who won the U.S. Supreme Court decision announced that they will challenge the new plan. The three-judge panel has set an Aug. 14 hearing on the new plan and could eventually order a special master to draw new lines for the state.

“The Alabama Legislature believes it is above the law. What we are dealing with is a group of lawmakers who are blatantly disregarding not just the Voting Rights Act, but a decision from the U.S. Supreme Court and a court order from the three-judge district court,” the plaintiffs said in a statement. “Even worse, they continue to ignore constituents’ pleas to ensure the map is fair and instead remain determined to rob Black voters of the representation we deserve,” the plaintiffs said.

Alabama will argue that the map complies with the court order and adheres to other redistricting principles such as keeping districts compact and not dividing communities of interest.

“The Legislature’s new plan fully and fairly applies traditional principles in a way that complies with the Voting Rights Act. Contrary to mainstream media talking points, the Supreme Court did not hold that Alabama must draw two majority-minority districts,” state Attorney General Steve Marshall’s office said in a statement. ”Instead, the Court made clear that the VRA never requires adoption of districts that violate traditional redistricting principles.”

In a July 13 letter to the state legislative redistricting committee, Marshall said the plaintiffs in the case “now demand a plan that provides not just a ‘fair chance’ to compete, but instead a guarantee of Democratic victories in at least two districts.”

Republicans, who have been reluctant to create a Democratic-leaning district, are gambling that the court will accept their proposal or that the state will prevail in a second round of appeals. In his letter, Marshall noted that Justice Brett Kavanaugh only partly joined with the Supreme Court’s 5-4 ruling against Alabama.

“I’m confident that we’ve done a good job. It will be up to the courts to decide whether they agree,” said Senate President Pro Tempore Greg Reed, a Republican from Jasper.

The three-judge panel that struck down Alabama’s existing map in 2022 said the “appropriate remedy” is a map with a second majority-Black district or “an additional district in which Black voters otherwise have an opportunity to elect a representative of their choice.” The judges added that it should include a second majority-Black district or “something quite close to it.”
