Could Juneteenth Be A Holiday?

The push to make Juneteenth a federal holiday.
Today is Juneteenth.

Friday was supposed to be the night Donald J. Trump was going to hold his controversial rally in Tulsa, Oklahoma. The incompetent president wanted to kick off his first campaign rally after three months of being held back because of the COVID-19 pandemic.

On social media he tweeted that he had to reschedule out of respect of his few Black supporters.



He had time to post two controversial tweets that Twitter flagged as manipulated media.




Trump was facing some serious flack over holding this rally. For one, he was holding this rally in Tulsa, the site of a terrorist attack on African Americans.

The destruction of Tulsa's Greenwood district happened in 1921. It was called "the single worst incident of racial violence in American history." The attack was carried out on the ground and from private aircraft, destroyed more than 35 square blocks of the neighborhood. The district was once the place where wealthy African Americans lived. They dubbed it "Black Wall Street."

That district sits northeast of downtown Tulsa.

So he decided to host it on Saturday and the city leaders, health officials and Oklahoma governor Kevin Stitt are pleading with Trump to reconsider the consequences of this rally.

To have a rally inside the BOK Center could put thousands of people at risk of exposure to the COVID-19. Trump bragged that millions of people want to see him. So that means folks from Kansas, Missouri, Texas and Oklahoma will travel to Tulsa to see him.

Trump also told people attending to not blame him or the campaign if they catch the virus.

Tulsa mayor G.T. Bynum, a Republican fears Trump's arrival will spark unrest in the city. With racial tensions rising in the wake of George Floyd killing and numerous other incidents with police, Tulsa could spark another week of unrest in the country. He issued a curfew for the city starting at 9pm and has threatened to shutdown Interstate 244, U.S. 64, U.S. 75 and U.S. 412 around downtown.

Today is Juneteenth, or the day when African Americans were freed. It's a holiday celebrating the liberation of those who were held as slaves in the United States. Originating in Texas, it's now celebrated throughout the United States.




The Emancipation Proclamation officially outlawed slavery. It took 2 1/2 years before Texas would eventually comply to the terms of the Confederacy's surrender to the Union.

Now there's a push to make it a federal holiday and kicking it off is Sen. Kamala Harris (D-CA) and Rep. Sheila Jackson Lee (D-TX).

A group of Senate Democrats announced Friday that they would introduce the Juneteenth National Independence Day Act, legislation to designate the day, and if passed, would make Juneteenth the first new federal holiday since Martin Luther King Day was recognized in 1983.

“Together with my colleagues Cory Booker, Tina Smith, and Ed Markey, we are proposing that Juneteenth be a national holiday. And we are dropping that bill saying that Juneteenth should be a national holiday."

“Juneteenth is about reclaiming our history, rejoicing in the progress we’ve made, and recommitting to the work yet undone. Our nation still has a long way to go to reckon with and overcome the dark legacy of slavery and the violence and injustice that has persisted after its end. Making Juneteenth a federal holiday represents a step forward in the journey of healing America is still taking," Sen. Cory Booker (D-NJ) said in a statement.

Tina Smith is a Democratic senator from Minnesota and Ed Markey is a Democratic senator from Massachusetts.

Jackson Lee introduced similar legislation to establish Juneteenth as a federal holiday in the House Thursday.



Trump made a snide remark in regards to Juneteenth. In a interview with The Wall Street Journal, he remarked about it. "I did something good: I made Juneteenth famous. It's actually an important event, an important time. But nobody ever heard of it."

The Senate Democrats' bill comes after Republican Sen. John Cornyn of Texas also announced plans to introduce a bill to make Juneteenth a federal holiday.

"Texans have celebrated this end to slavery for 155 years. It's an opportunity to reflect on how far we've come and a reminder of how far we still have to go," he tweeted Thursday.

Congress has the authority to create federal holidays -- any legislation would need to clear both the House and Senate before being signed into law by the president.

Despite President Abraham Lincoln's signing of the Emancipation Proclamation -- which ordered the abolition of slavery in the Confederacy -- it took 30 months and 19 days for the order to be carried out in Galveston, Texas -- the last part of the Confederate States of America where African Americans were still enslaved.
Democrats are pushing for civil rights. .
For 155 years, communities around the country have celebrated June 19 -- the day Gen. Gordon Granger arrived with Union soldiers in Galveston -- as Juneteenth.

While all but three U.S. states recognize the day, the holiday was thrust into the national political spotlight recently after President Donald Trump scheduled a campaign event for June 19 in Tulsa, Oklahoma -- a city notorious for one of the nation's worst instances of racial violence.

The president later moved the date of the rally to June 20, tweeting his decision was made "out of respect" for the holiday.

Congressional calls for a federal Juneteenth holiday come amid similar support from corporate executives and sports officials.

NFL Commissioner Roger Goodell announced this week that he would close league offices on Juneteenth. Twitter CEO Jack Dorsey said he planned to make June 19 an annual holiday.

State officials have also recently moved to give greater recognition to the date. New York Governor Andrew Cuomo signed an executive order declaring June 19 a paid holiday for state employees.

Virginia Democratic Gov. Ralph Northam also said he plans to make Juneteenth a permanent paid state holiday.

"It's time we elevate Juneteenth not just as a celebration by and for some Virginians, but one acknowledged and commemorated by all of us. It mattered then because it marked the end of slavery in this country, and it matters now because it says to Black communities, this is not just your history—this is everyone’s shared history, and we will celebrate it together," Northam said in a statement Tuesday.

Democrats and Republicans see the writing on the wall. The years of watching African Americans take abuse has to stop. We need get the ball rolling now. I am tired of being subjected to being considered less than human in the eyes of extremists.

If we can eliminate the anti-Black mentality of some folks in this country, the path to equality should eventually come. Over 400 years of this bullshit is enough.

The two dirty cops who killed Rayshard Brooks got their mugshots.

The two dirty cops who were accused of murdering Rayshard Brooks turned themselves into custody.

The former cops who I won't name were booked into the Fulton County lock up. The one former cop who didn't fire his service weapon on Brooks was released on a $50,000 cash out. The one former cop who did fire on Brooks is not getting a cash out.

The two are facing a list of charges.

The one who fired his service weapon has 11 charges. The murder charge in Georgia alone is the LIFE or DEATH card. The charges alone include failure to render aid, improper discharge, lying on statements, aggravated assault with a deadly weapon, unbecoming of a peace officer and reckless endangerment.

The one cop who didn't fire has five charges on him. The failure to render aid, aggravated assault, lying on statements, unbecoming of a peace officer and reckless endangerment could net him at least 20 years in the iron college. That cop is planning to turn on the one who shot Brooks.

The charges were swift. Almost a few days after the shooting, the mayor of Atlanta, Keisha Lance Bottoms fired that cop, placed the cop in the freezer and fired her police chief Erika Shields.

The city had nights of unrest after that shooting. The Wendy's Restaurant where the shooting happened was set on fire.

The Atlanta Police Department has also had a mutiny among its force. A handful of dirty cops decided to have a "sick" day because of the criminal indictments towards those two. Some have resigned from the force.

The incident happened a week ago.

A call was placed to the police. The call was detailing Brooks being asleep in his vehicle while in a drive thru lane. The Atlanta Police arrived and woke him up. During the encounter, it started off cordial but once they did a DUI test, the situation escalated and then the two cops and Brooks got into a scuffle.

During the scuffle, one of the cops deployed his taser and shocked Brooks. After Brooks wrangled away from them, he grabbed the taser and ran off. He ended up trying to use the taser but he didn't get a chance to. The cop fired three shots into his back.

They failed to help him while he was bleeding to death. He would die at the local hospital.

Now his wife and her family have to prepare for burial.

They believed that he was afraid he might have to go back to the iron college. Brooks even admitted that he's no saint but he said in a video that was released that he wants the world to know that he's a human being and not an animal.

Protests are continuing in country post George Floyd. Many of these cops who abuse their power are being held accountable. Trust me, there's more than just these incidents. We have a laundry list of "What Happened To....?" on this blog alone. The list is growing by the week.

I have been lazy these last few days. But I am certainly covering as much as I can.

With Blogger changing their format to "simplify" the way of doing posts, I am starting find myself waning down on the blog.

Not saying I'm completely giving up, but once 2021 comes, I think I'll return to posting on occasions.

We have unrest in the nation. African Americans and Native Americans had enough of the status quo in politics, religion, entertainment and law. The need to change started on May 25, 2020 when a cop placed his knee on the neck of an American citizen. He screamed, "I can't breathe...." and cried for his "mama."

We have mass shootings in the United States everyday. We are the only country in the world that continues to do nothing about this. Donald J. Trump, Congress, the National Rifle Association and agitators in the junk food media have moved on from dealing with this. They're too busy sniping over partisan blame games. With Trump being impeached while in office, he's unlikely to focus on gun violence and now police reform. He's more interested in saving his disgraceful presidency.
Progress is happening. Despite the coronavirus, people are out protesting against racial inequality.
Trump and lawmakers elected to federal office made politics extremely toxic. It's not just the fault of our dear leader and lawmakers, but relentless agitators on the 24/7 cable news channels. They are profiting off division and divisiveness. The internet is also a problem. It's is a breeding ground for potential mass shooters. Facebook, Twitter, Google and other social media outlets have been "ground zero" for disinformation, partisan threats and social activism. Incels and social outcasts find their outlets on sites that inspire them to cause harm to their fellow human beings.

It never happens in your community.......! Until it does! Every community in the United States will eventually have a legacy. A legacy of tragedy. A person of color killed by police or a mass shooting will affect your town, your family and your life. So I don't want to hear that bullshit about how "guns save lives." They don't. The only thing that survives a gun shooting is the gun.

FOR EVERY BAD COP, THERE WILL BE A DEAD COP!

We Live In This Development! Why Are You Gonna Call The Law On Us?

Don't you get tired of these white men and women threatening to call the law on you for minding your own business?

I know I and many people of color will experience a "Karen" or "Kevin" throwing out their privilege and threatening police action on you for doing nothing more than being Black in America.

The rules only apply when White people get their way. I guess that's how life works right?

There's so many incidents of white people either coughing on people of color, threatening police interaction for doing a minor infraction or threatening gun violence for being in a white neighborhood.

So down in South Florida, a white man is probably wishing he didn't act foolish that evening.

This white guy named Lee Jeffers becomes the latest pariah in the country because of his ridiculous antics towards people of color. The young girls were in a golf cart driving around the development and the white guy saw them and was fumed about them treating the golf cart like a toy. So he decided to confront them.

The exchange between Jeffers and a group of teenage girls took place in Wellington, Florida.

However, the video only starts after Jeffers has pulled over and gotten out of his car.

"You don't belong......" will be forever etched.

This incident happened on Sunday.




Tony Nelson, 62 said his granddaughter was targeted by this white guy for no fucking reason. He told her to share this video on social media.

"It's not going away," said Nelson. "I can't let it die....People aren't understanding what's going on."

His granddaughter, Breonna Nelson-Hicks said that the man followed them around the development and towards her friend's home. He was yelling at them, so she told her grandfather.

The teens crossed Lake Worth Road from one development, The Isles, to Grand Isle another development where the Nelsons lived. They stopped at the security guard gate and drove to Breonna's home.

That's when the teens said that this white guy started tailgating them. The boy who was driving the cart tried to pull aside to let the guy pass but he decided to stay on their tail.

Soon after they parked the golf cart, the boys ran and the young girls decided to walk the rest of the way. They didn't expect the car to follow them. And as they got near the home, the white guy gets out and confronts them.

So they whipped out the cellphone and then it recorded the encounter.

The video last under two minutes.

Nelson later would say that the incident "was not about the golf cart."

"I don't car if you take my picture ... because you don't belong in this development," the man yells at the young girls.

Breonna is Black and her two other friends are white. Her white friend recorded the encounter.

According to the video posted on social media and shared by Nelson with The Palm Beach Post, a tense verbal exchange then followed.

"What's your name?" the man yelled at Breonna.

"I'm not telling you," the girls replied.

"I live here," Breonna said.

"OK, where do you live?" he asked.

"Why would I tell you any of this?" one of the girls said.

"OK, I'm going to call the gate and have you all arrested," the man said. "You do not deserve to be in here."

"OK," one of the girls said. "What did we even do wrong?"

The man turned to the woman who lives across the street from the Nelsons. Hearing the commotion, she had come outside and stood at the foot of her driveway.

"Seriously?" the man said to her. "I have to wait five minutes while they're strutting around in the road."

That's when Breonna went and got her grandfather. As she walked to her front door, the man appeared to begin to follow her.

"Yeah, bring him out right now, bring him out right now," the man said.

The neighbor is heard speaking to the teens "Just don't argue, guys," she said. "It's not worth it."

The teens thanked her and were met with more yells from this man.

"It is because you're driving illegally," the man said.

"OK, but you're coming at 15-year olds," the girl holding the cellphone said.

"So you're going to hit us with a car?" the other teen said.

"Because you're 15 years old?" the man said. "You can marry in Mississippi or Alabama."

That's where we went into sexual predator territory. How the fuck does he know about age of consent? Does he have some kind of fetish for underage children? That remark was totally inappropriate for him to say.

The girls scoffed at that notion. Breonna's grandfather came out the house and confronted this guy.

"Don't stick your hand out," Nelson said. "Did you threaten a child?"

"I did not threaten, I did not threaten a child," the man said, lowering his hands and beginning to back away.

"I have it on video," the girl recording said.

Nelson told the girls to go inside, then asked to see the video.

The Palm Beach Sheriff's Office had received a complaint from the guy.

"I am told unless this is a low-speed vehicle with a tag on it, the golf cart is not supposed to be driven on the road," the spokeswoman for PBSO said. "As the video shows, the male confronted the juveniles and some of what he said would be in-line with the fact that the golf cart should not be on the road. We received two calls when the deputies arrived, the male had already gone home. Deputies did speak to the juveniles and made contact with the male the next day. Based on both accounts no crime was committed."

The encounter didn't end up with anyone being arrested. However, the folks on social media quickly identified this asshole.

He works for the United States Citizenship and Immigration Services (USCIS) and he's being placed on administrative leave pending a potential cannon firing.

USCIS said the man's actions were disturbing.

"USCIS holds its employees to the highest standards of integrity and professionalism regardless if they are on or off duty. We are looking into the matter that has been reported in the press about this individual's off duty behavior. The video is certainly disturbing, and we are working to get all available information in considering what action, if any, may be appropriate for the agency to take."



Alt-White Troll Banned From American Airlines!

Far-right troll gets banned from a flight because he refused to follow rules.
The controversial "Gays For Trump" agitator Brandon Straka was forced off an American Airlines flight due to his grandstanding over the facial protection rules the airline imposed on passengers.

The troll claims he was once a progressive but chose to #WalkAway from the Democratic Party and progressive policies. He is often associated with the alt-right movement. He is friends with far-white LGBTQ agitators like Scott Pressler, Tammy Bruce and Milo Yiannopoulos.

The agitator is outraged that he was forced off a flight because he refused to wear a facial mask.





The troll complains that he was on a flight from New York to Dallas when he was told that he must war facial protection that is compulsory under the new airline rule.

He started a Periscope broadcast and streamed it through Twitter.

In a statement, American Airlines said that they are aware of the incident.

"After [the passenger] refused to comply with the instructions provided by the flight crew, our team members asked him to deplane. He deplaned and the flight departed the gate four minutes late at 12:34pm ET."

He waited three hours before he booked another flight. By that time he was wearing facial protection.

Now he's on a list of a passengers who could be permanently banned for not complying to the company's policies. Since the COVID-19 pandemic is an ongoing crisis in the country, the United States has seen a massive uptick in confirmed cases and deaths.

There are over 4 million cases (2.5 by government confirmation). There are over 140,000 dead (119,000 by government confirmation). We have undercounted thousands and some have died without even being confirmed to have this.

Straka and many like him believe that wearing a mask infringes on their right to be free. I see it and I've seen friends, co-workers and people across my community not adhere to the guidelines imposed by the CDC, FDA and U.S Health and Human Services.

The troll who appears on Fox News as a contributor. He is often spotted around college campuses trying to encourage people to leave the Democratic Party and join Trump's carnival of bigotry.

Here's things to remember about the coronavirus. Revised.

1. Wash your hands frequently. Wash for at least 20 seconds (two Happy Birthday songs).
2. Do not touch your face (mouth, nose and eyes)
3. Cough into your elbow instead of your hands.
4. Keep a safe distance (at least 6 to 10 feet) from individuals. Businesses are now issuing social distancing and will have the right to refuse service if you're not adhering to the guidelines.
5. If you're sick, please stay home. You could spread the disease to others and trust me, you could face legal ramifications if you're sick and you deliberately showing up to work.
6. There is no treatment or cure for the COVID-19.
7. Follow state and federal laws regarding this. Some states have relaxed regulations but that doesn't mean you're fully able to return to normal life. You have to stay vigilant and remind yourself that you can still catch this despite social distancing and safe sanitation practices.
8. Do not hoard items like toilet paper, milk, eggs, bread, gloves, hand sanitizer, etc.
9. Use social media like Facebook Messenger, Meet, Zoom, Google Duo, Skype or social media to connect.
10. COVID-19 can live on surfaces for more than 72 hours. Including steel, plastic and cardboard.
11. A pandemic has no timeline. The coronavirus is new and scientists are trying to figure out how to combat this.
12. COVID-19 doesn't care about borders. The coronavirus spreads from human to human contact. We have no confirmation on how it made it to the United States. Don't believe what Donald J. Trump says about it coming from China. It was detected in China, then Italy and our first confirmed case was in January 2020 in the United States. We probably had thousands of people affected in 2019 and we just didn't know it.
13. If you deliberately infect other individuals, food and first responders, you will be charged with crime. So if people are trying to cough on you, sneeze on you, lick food products, lick toilet seats and refuse to wear masks where its required, they could face criminal charges. This is a controversial issue because some believe the mask isn't protecting them and some don't care about you or your family's health.
14. If you have signs of bluish lips or face, inability to wake or stay awake, new confusion, persistent pain in the chest, trouble breathing or blood in cough, call 9-1-1. There are mobile testing sites in your community but always check with a doctor first before getting a test at a public center. Most doctors will not take you openly without facial protection and confirmed symptoms.
15. Not all symptoms of COVID-19 are confirmed or denied. New issues keep showing up. So don't believe everything you've heard. The most common symptoms are noted above. Also please note that asymptomatic individuals are folks who have no symptoms but are spreading. Those are folks who look normal but have it and not showing signs yet.

According to the CDC, there is still not enough information on antibodies for COVID-19 and whether they can prevent someone from getting reinfected. It still recommends that people with a positive antibody test follow recommendations for protecting themselves and others.

The coronavirus doesn't care about your age, race, gender, sexuality, nationality, religion, politics, economic or social standings. It doesn't care about anything. It's a living organism that causes mild symptoms that include: fever, sore throats, chills, respiratory issues, loss of taste or smell and other unknown symptoms. If you have a weak immune system or health issues, your risk increases.

Death does happen to at least 40% of those who are affected by COVID-19.

Healthy people can die from this. Take this seriously. You only have one life!

Andy Barr's Wife Passed Away!

Rep. Andy Barr (R-KY) loses his wife to heart disease.
Kentucky lawmaker loses his wife to heart disease. The far-right lawmaker learned on Tuesday that his wife (Eleanor) Carol Barr passed away at the age of 39.

Garland Hale Barr IV, known as Rep. Andy Barr (R-KY) is a far-right lawmaker from the 6th U.S. Congressional District in Kentucky. He represents Lexington, Richmond and Frankfort, Kentucky.

 The 48-year old lawmaker announced that his wife died suddenly of a rare heart disease.

"Congressman Andy Barr's wife Carol passed away suddenly tonight at the family home in Lexington. During this tragic time, we respectfully ask for privacy for Congressman Barr and his family to grieve Mrs. Barr being called home to heaven," said chief of staff Mary Rosado.

The lawmaker and his wife have two daughters.






According to the Fayette County bag'em ups, Barr's death was caused by Mitral Valve Prolapse (Floppy Valve Syndrome). The matter of death was natural causes.

The heart has four valves to make sure blood is pumped in the right direction. One of those valves, the mitral valve, can become damage so that it can't direct the flow of blood properly. Sometimes people born with condition, other times it results from heart disease or infections. If the prolapse becomes very severe, the heart can no longer pump blood properly, leading to death.

Mike Pence, Sen. Mitch McConnell (R-KY), Sen. Rand Paul (R-KY), Gov. Andy Beshear and other lawmakers extend their condolences to the Barr family.

His former opponent now U.S. Senate candidate Amy McGrath extended her condolences to the lawmaker as well.



SCOTUS Downs Trump's EO On DACA👪!


The Supreme Court deals Trump a blow. He can't repeal DACA.
The Supreme Court ruled against the Trump administration when it came to presidential executive orders. The current president cannot end the Deferred Action for Childhood Arrivals. The DACA program is spared for the time being. Children who arrived into the United States through no fault of their own are allowed to get legal protections if they work and stay out of trouble with law enforcement..

Trump was going to end the program that would have affected 650,000 young immigrants and possibly their children who were born in the United States.

Department of Homeland Security v. Regents of the University of California was a Supreme Court case that ruled on the 2017 U.S. Department of Homeland Security (DHS) order to rescind the Deferred Action for Childhood Arrivals (DACA) immigration program established in 2012.

DACA was established under President Barack Obama to allow children brought into the United States without proper immigration authorization to defer deportation and maintain good behavior to receive a work permit to remain in the U.S.; such children were also called "Dreamers" based on the failed DREAM Act. On his election, President Donald Trump vowed to end the DACA, and the DHS rescinded the program in June 2017. Numerous lawsuits were filed, including one by the University of California system, which many "Dreamers" attended, asserting that the rescission violated rights under the APA and the right to procedural due process under the Fifth Amendment.

The University sought and received an injunction from the District Court Judge William Alsup to require DHS to maintain the DACA until the case was decided. DHS challenged this order to the United States Court of Appeals for the Ninth Circuit, which upheld Judge Alsup's ruling in November 2018, and ordered the DHS to maintain the DACA throughout the U.S.

In a 5-4 decision, with Chief Justice John Roberts joining the progressive members to author the opinion, the court said the Department of Homeland Security's move to eliminate the program was done in an "arbitrary and capricious" manner although they did not rule on the merits of the program itself.

Roberts along with progressive justices Stephen Breyer, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan ruled on the decision. The four conservative justices Samuel Alito, Clarence Thomas, Brett Kavanaugh and Neil Gorsuch shunned the ruling.

"We do not decide whether DACA or its rescission are sound policies. 'The wisdom' of those decisions 'is none of our concern,'" Roberts wrote in his opinion. "We address only whether the agency complied with the procedural requirement that it provide a reasoned explanation for its action."

Trump quickly reacted to the decision, which came days after an opinion from his own appointee Justice Neil Gorsuch that said employment discrimination based on sexual orientation or gender identity was prohibited under Title VII of the Civil Rights Act.

"These horrible & politically charged decisions coming out of the Supreme Court are shotgun blasts into the face of people that are proud to call themselves Republicans or Conservatives," Trump tweeted Thursday morning, suggesting that the Second Amendment could be at risk if he does not get elected and have the chance to potentially appoint more justices.

Trump can try again but he will have to do it through legal channels and not through an executive order.

This is a blow to a huge campaign promise that he would eliminate DACA by the end of his first term.












This issue will certainly play upon Trump's base who continues to hold an anti-immigrant stance. We are experiencing a global pandemic, record unemployment, over 140,000 people dead from COVID-19, unrest in the country due to the fatal police shooting of African Americans and we're in a major recession.

In Thursday's opinion, Roberts wrote that when the administration rescinded DACA it "failed to consider the conspicuous issues of whether to retain forbearance" -- referring to the non-enforcement of immigration laws to remove those with DACA protection -- as well as the impact the decision would have on DACA recipients who have relied on the program.

"That dual failure raises doubts about whether the agency appreciated the scope of its discretion or exercised that discretion in a reasonable manner," Roberts wrote, noting that the administration could have scrapped the benefits provided by DACA while keeping the non-enforcement policy, but instead eliminated all of it without even giving a reason for ceasing non-enforcement.

"The appropriate recourse is therefore to remand to DHS so that it may consider the problem anew."

Trump vows to carry forth despite the setback.
The program was established through an executive order from Obama that the Trump administration argued was improper to begin with, claiming this should have been done via legislation from Congress.

Roberts made clear that the administration does indeed have the power to rescind DACA, just not in this fashion.

"The dispute before the Court is not whether DHS may rescind DACA. All parties agree that it may," the chief justice wrote. "The dispute is instead primarily about the procedure the agency followed in doing so."

The Trump administration had argued that the decision to eliminate DACA does not fall under the purview of the APA because DACA itself was merely a decision not to enforce existing law against a certain group of people. The Supreme Court disagreed, noting that "DACA is not simply a non-enforcement policy" because it is an actual program where people apply to receive a benefit.

"In short, the DACA Memorandum does not announce a passive non-enforcement policy; it created a program for conferring affirmative immigration relief," Roberts wrote. "The creation of that program—and its rescission—is an 'action [that] provides a focus for judicial review.'"

The court also disagreed with the administration's position that the Immigration and Naturalization Act prohibits the decision to rescind DACA from being reviewed by the courts.

Justice Clarence Thomas wrote in a dissenting opinion that the decision to repeal DACA was correct, and that the majority is holding the Trump administration's decision to a higher standard than the order that established DACA in the first place.

"These cases could—and should—have ended with a determination that his legal conclusion was correct," Thomas wrote. "Instead, the majority today concludes that DHS was required to do far more."

He continued: "Without grounding its position in either the APA or precedent, the majority declares that DHS was required to overlook DACA’s obvious legal deficiencies and provide additional policy reasons and justifications before restoring the rule of law. This holding is incorrect, and it will hamstring all future agency attempts to undo actions that exceed statutory authority. I would therefore reverse the judgments below and remand with instructions to dissolve the nationwide injunctions.”

Thomas accused the court's majority of wanting to avoid making waves, even it if meant getting the law wrong.

In a line that Trump retweeted Thursday morning, Thomas said, "Today’s decision must be recognized for what it is: an effort to avoid a politically controversial but legally correct decision."

At issue was a program created under executive order that gave about 700,000 people brought to the United States illegally as children the opportunity to receive a renewable two-year period of deferred action from deportation and become eligible for a work permit.

Hundreds of "Dreamers" and their supporters had rallied outside the court during the November oral arguments. Some carried signs, such as "Build Bridges, Not Walls." Trump at times seemed to be pressing instead for a legislative solution, and had tweeted earlier that morning that if the administration prevailed, "a deal will be made with the Dems for them to stay!"

The Trump administration announced its plan to phase out the program in 2017, only for the federal courts to rule that it could not apply retroactively and that DACA should be restarted in full. The White House fought back on those decisions, saying the president has broad authority over immigration enforcement policy.

The Justice Department had argued the DACA program is not working and is unlawful, and that the president should have the "absolute discretion" to adopt a revised overall immigration strategy. A dozen states led by Texas were among the parties backing the administration.

DACA proponents have argued that Trump’s planned termination violates federal law requiring adequate notice-and-comment periods before certain federal rules are changed, as well as other constitutional equal protection and due process guarantees.

They say the government has given only cursory explanations for justifying DACA's demise. By contrast, they say, the economic and social benefits for Dreamers and for the country are indisputable.

A host of civil rights groups filed separate briefs in support, along with several states including New York and California.





The Feds Bust Sexual Predator Actor Danny Masterson!

Entertainer faces sexual assault charges.
The 44-year old entertainer is facing a federal sandwich. He may lose his freedom, his career, his lovely wife, Bijou Phillips and his family. This is the results of the #MeToo Movement which still exists despite the false allegations from Alexandra Tara Reade McCabe Moulton.

His name is only going to be mentioned in title and once in story. From this point, he's a predator.

The Associated Press said that the former That 70s Show actor is indicted on three rape charges.

In the state of California, any conviction of rape is automatic 25 years in the iron college. If he traveled state lines to commit any acts on women or children, he will be indicted by the feds. He will face a possible LIFE in federal time out if convicted. He will be labeled a TIER III in Offender U and his victims will receive any royalties from his music, acting and productions.

Okay, Danny Masterson is facing some serious charges. This was from the allegations of three women he engaged in contact with in early 2000s. The Los Angeles County prosecutors said on Wednesday, the culmination of a three year investigation that resulted in a rare arrest of the famous entertainer is a byproduct of #MeToo.

The three counts of rape by force or fear against the predator were filed on Tuesday, and an arrest warrant was issued. The predator was arrested Wednesday morning and TMZ and E! reported the arrest late Wednesday afternoon. He was released a few hours after posting a "get out free card."

The attorney Tom Mesereau, famous for defending Michael Jackson said his client is innocent and he feels "confident that he will be exonerated when all the evidence finally comes to light and witnesses have the opportunities to testify."

Prosecutors alleged that the predator raped a 23-year old woman sometime in 2001, a 28-year old woman in 2003, and a 23-year old woman he had invited to his Hollywood Hills home in 2003.
The predator could lose everything including actress Bijou Phillips.
If convicted, he will face 45 years. That's 25 for rape, 20 for kidnapping.

Prosecutors declined to file charges in two other cases that the police investigated, one because of insufficient evidence and the other because of the statute of limitations had expired.

The predator is married to Phillips since 2011. They have children together.

"Obviously, [our client] and his wife are in complete shock considering that these nearly 20-year old allegations are suddenly resulting in charges being filed, but they and their family are comforted knowing that ultimately the truth will come out," said Mesereau.

The suspect is innocent until proven guilty in a court of law.

John Bolton: Trump Put His Ego Ahead Of The Country!

Donald J. Trump and the U.S. Justice Department are fighting to keep a book off the shelves. A book from the controversial former National Security Advisor John Bolton.

Trump attacked former national security adviser John Bolton during several interviews late Wednesday, saying the former aide didn't get approval to publish a forthcoming book about his White House experience and therefore broke the law.

"He is a liar," Trump told The Wall Street Journal, adding that "everybody in the White House hated John Bolton."

Bolton, a former UN Ambassador under George W. Bush and former Fox News agitator joined Trump in 2018 and stayed on until 2019. During his time, he took notes. He saw things that made him really concerned about the way things were going.

Trump claimed he fired him out the cannon, Bolton said he resigned.

Now it's 2020 and a book about his time working with Trump is coming out. Trump vows to stop the book from its release because it contains "classified information." He said that Bolton could face criminal charges.

According to Bolton's as-yet unpublished draft manuscript, Attorney General William Barr and Bolton had a conservation about Trump had appeared to have undue influence over two U.S. Justice Department investigation of companies in China and Turkey; specifically regarding China's leader Xi Jinping with regard to ZTE and Turkey's leader Recep Tayyip Erdogan with regard to Halkbank.

Bolton claimed that Trump in a desperate attempt to win reelection in farming states wanted Xi to buy American soybeans and wheat. He wanted to get Trump on record about that but was denied access. Trump had no problems with China's concentration camps towards Muslims and opposition opponents.

Bolton described Trump's failure to recognize foreign policy. This was said before. Bolton claimed that Trump thought Finland was a part of Russia.

Bolton claimed that Secretary of State Mike Pompeo said that Trump was full of shit. He said during the highly publicized meeting between Kim Jong-Un and Trump, Pompeo smirked at the fact that Trump was giving too much to the North Korean dictator. Bolton said that North Korea played Trump for a fool.

Bolton said that Jared Kushner was inexperienced. During the conversation between Trump and Israel's corrupt prime minister Benjamin Netanyahu, Bolton said that members were shocked to learned that the plan to move the embassy from Tel Aviv to Jerusalem was inspired by Kushner.

Trump didn't know that the United Kingdom had nuclear weapons.

Bolton also said that Trump demanded Ukraine to investigate Joe Biden. He withheld funds for the Ukraine government because he believed the country was sitting on damaging dirt on Biden.

That led to his impeachment. Trump was impeached in December 2019.

He was not convicted and removed from office in February 2020.

Bolton was supportive of Trump when he first got into office. He was practically begging for a job with Trump. After Trump fired H.R. McMasters out the cannon as National Security Advisor, Trump saw Bolton as a good man who knew how to speak to America.

Behind the scenes, Trump ruthlessly mocked him. He said he hated the mustache. He said that mustache make Bolton look like a dork.

Bolton was a fierce critic of Iran and wanted Trump to pull out of the Iran Nuclear Deal.

While his book has skyrocketed to the top of New York Times bestsellers listings, the Democrats have criticized Bolton for being a coward for not testifying to the impeachment trial.

Bolton said that he would speak if the court subpoenaed him to testify. Republicans have blocked witnesses to testify in the trial and it led to Trump to not be convicted.

Dirty Cops Got Hit With Charges In Rayshard Brooks Death!

Dirty cops face murder charges for Rayshard Brooks.
They said it's going to be hard to convict a police officer. After all, he's alive and the victim is dead.

The perception is always give the cop "the benefit of the doubt" whenever they use force against a suspect. But what was seen on that video was surely a cold-blooded killing. You can't tell me that an intoxicated man running with an already deployed taser is a threat. A threat where a cop places two bullets into the man's back. The lack of sympathy and failure to render aid also shows a character of "shoot first, question last" mentality.

These two officers now will face a judge in regards to their actions. With all that training on deescalating conflicts, many of America's law enforcement seem to not understand this.

"WE ALL WANT TO GO HOME TONIGHT!"

We have a global pandemic that is killing 125,000 Americans. The coronavirus deaths are still happening and folks are not social distancing. We have an economic recession. With the coronavirus spreading from coast to coast, many companies are closing up for good and placing Americans out of work. They are over 45 million Americans out of work. There are thousands of Americans who are being killed by gun violence. Everyday at least 95 people died from gun violence. I can't even tell you how many stories I've missed involving gun violence in the country.

WHEN COPS SEE A BLACK MAN WITH A FIREARM REGARDLESS OF IT BEING LEGAL OR ILLEGAL, THEY AUTOMATICALLY SHOOT THE BLACK MAN. EVEN AN UNARMED BLACK MAN JUST REACHING FOR A WALLET OR A DOOR HANDLE COULD BE KILLED BY THE COPS. NOW A BLACK MAN FLEEING AN ARRESTING OFFICER COULD BE KILLED. WHETHER THEY'RE IN THEIR VEHICLE OR RUNNING FROM THEM. THE COPS WILL SHOOT THE BLACK MAN.

THE POLICE AND JUNK FOOD MEDIA TRY TO MAKE THE VICTIM, "THE BAD GUY" BY BRINGING UP HIS PAST HISTORY, HIS SOCIAL MEDIA OR HIS FAMILY LIFE.

WHENEVER SOMEONE COMPLAINS ABOUT THE LACK OF BLACK FATHERS, I CONTINUE TO DENOUNCE THIS BULLSHIT. I OFTEN REMIND THEM THAT THE POLICE KILL BLACK FATHERS. THE POLICE LEAVE CHILDREN OF COLOR WITHOUT A BLACK FATHER. AND NO AMOUNT OF MONEY COULD BRING THE PEACE AND TRANQUILITY TO THE FAMILIES OF THOSE KILLED BY THE COPS.

We have unrest in the nation. African Americans and Native Americans had enough of the status quo in politics, religion, entertainment and law. The need to change started on May 25, 2020 when a cop placed his knee on the neck of an American citizen. He screamed, "I can't breathe...." and cried for his "mama."

No amount of criminal acts this man done justified that cop's actions. It's has frustrated me to hear folks like Candace Owens, Larry Elder, Leo Terrell, Jesse Lee Peterson, Terrence K. Williams, Kevin Jackson, Diamond & Silk and Allen West defend the actions of bad cops and white vigilantes.

And of course, leftists like Cornel West, Nina Turner, Jeffery Shaun King, Benjamin Dixon and Killer Mike are throwing their weight into the debate. These coons are trying to infiltrate the debate with "pie in the sky" policies from a failed presidential candidate Bernie Sanders. They are deliberately sabotaging the Democratic Party's chances of winning the election. Black voters picked their nominee and these coons are trying to sow discourse to white progressives and young voters.

I don't give a fuck about someone's past encounters with police. That doesn't justify the death of anyone.
The two cops were cordial to Rayshard Brooks at first. After a scuffle, one cops shots Rayshard in the back.
The two former cops, Garret Rolfe, 27 and Devin Brosnan, 26 will be issued warrants for their arrest.

The two will face charges that could put them in the iron college for a lengthy amount of time. The charges against Rolfe are considered a matter of his LIFE or his DEATH.

The murder charges handed to Rolfe as well as 10 other indictments will put him in the county lockup without a bond. His case could be a LIFE or DEATH card. Brosnan, who faces criminal misconduct and failure to render aid also face criminal charges that could put him in the iron college for up to 30 years.

Brosnan had also did the smart thing. He plans to testify against Rolfe and tell the court that his actions were wrong and they should have handled the matter differently.

He was given a hefty bond. The prosecutor is asking for the court to not offer any "get out" cards.

The two are likely on suicide watch and they will be monitored by Fulton County Sheriff.

The former cop also shot into a person's vehicle. That automatically goes to reckless discharge of a firearm. That could put an additional five on his belt.

Aggravated assault in Georgia is 20 years and both former cops have that charge on their belt.

Violations of oath as a peace officer are charges that could put them in the iron college for three years.

In total, both dirty cops could have a long lengthy bid in the iron college if convicted. The one who shot Rayshard Brooks has the most the lose.

Fulton County prosecutor Paul Howard said the evidence is there to land a conviction of both officers but he said that they will have a strong defense. The police unions in the United States have backed the dirty cops. Some on the far-right believe the actions of Brooks let to his own death and believe this is a political witch hunt in the wake of protests post George Floyd.

The suspects are innocent until proven guilty in a court of law.
Rayshard's family still upset that these cops killed him. They believed if the suspect was white, he would have lived.
Trump and lawmakers elected to federal office made politics extremely toxic. It's not just the fault of our dear leader and lawmakers, but relentless agitators on the 24/7 cable news channels. They are profiting off division and divisiveness. The internet is also a problem. It's is a breeding ground for potential mass shooters. Facebook, Twitter, Google and other social media outlets have been "ground zero" for disinformation, partisan threats and social activism. Incels and social outcasts find their outlets on sites that inspire them to cause harm to their fellow human beings.

It never happens in your community.......! Until it does! Every community in the United States will eventually have a legacy. A legacy of tragedy. A mass shooting will affect your town, your family and your life. So I don't want to hear that bullshit about how "guns save lives." They don't. The only thing that survives a gun shooting is the gun.

FOR EVERY BAD COP, THERE WILL BE A DEAD COP!

We will talk about this for a few days and then we're off to another controversy. The next controversy would either be something done by Trump, a politician, an entertainer or we will experience another mass shooting. The next mass shooting will be even worse than the last one.

I repeat myself over and over again! I use the same old copy and paste. I hear the same trolls saying that there's nothing we can do. I keep hearing "concern" trolls telling us that it's their own fault for their own deaths. I hear the same old talking points about "good guys with guns" and "god's given rights."

Every time these folks offer "thoughts and prayers," "their condolences," "their hearts going out to," and "their apologies," they are not sincere. For every naming of a road, park, bench, building and holiday, it won't matter to the community. For every time they lower flags, offer moments of silence and candlelight vigils, we just offer "feel good-isms."

The website Officer Down is a memorial to those who were killed in the line of duty. Those who don't get their names mentioned in the junk food media. Also the website the National Gun Violence Memorial also keeps record of the many individuals killed by gun violence.

We have mass shootings in the United States everyday. We are the only country in the world that continues to do nothing about this. Donald J. Trump, Congress, the National Rifle Association and agitators in the junk food media have moved on from dealing with this. They're too busy sniping over partisan blame games. With Trump being impeached while in office, he's unlikely to focus on gun violence.



Alexis Ohanian: I'm Leaving Reddit! I Want My Daughter To See A Black CEO One Day!

Alexis Ohanian resigns from Reddit because he wants Silicon Valley to hire people of color.

Alexis Ohanian has stepped down from social media blog Reddit. He said that he wants his position filled by a person of color. He said that he wants his daughter to see progress in Silicon Valley.

Ohanian is married to American tennis star Serena Williams and the two have a child together.

Ohanian expressed regret that Silicon Valley lacks diversity. The country's top billionaires in technology are white.

The business mogul has told a story about a police encounter in 2005. He said he fell asleep in his car after a night of drinking. He said that he was under the influence and has a ounce of weed in his pocket.

I'd had some fun with friends that evening and when I got back to my car, I knew there was no way I was driving anywhere, so I reclined the seat and passed out. The light of a police officer woke me up some time later, he asked me to step out of the car, so I did the best I could to stabilize my 6'5" frame as he asked how much I'd had to drink and then asked if I was capable of driving home. I was pretty drunk (and high), so I couldn't say anything terribly coherent other than "No dRIvE. nO DrIVe." and I just repeated that to answer every question until he got frustrated and asked me to call some friends to pick me up. While we were waiting, the cop said how lucky I was that I didn't have the keys in the ignition, even with the car off, because it would have been way worse for me. I thanked him (I think) and got home safe except for a bad hangover the next day. For years, those friends and I would tell that story + laugh about that night... It was just a stupid college story. #BecauseIWasWhite. I walked away + entered Y Combinator--not a jail cell...or worse. I became an entrepreneur, not a statistic. I'm grateful for that police officer's tolerance with me + disgusted that it's so obviously not afforded (and never been) to everyone just because of their race.

Ohanian announced his resignation from the Reddit board on June 5, urging the company to fill his seat with a black candidate. His resignation followed criticism of Reddit on June 2 from former CEO Ellen Pao for "amplifying" racism and hate. In a blog post Friday, Reddit CEO Steve Huffman said the platform will also change its content policy to "explicitly address hate."

"I think if we follow this drumbeat of support, both offline and online, I think we're going to see more and more tech businesses in particular taking more responsibility over not just the content on their platforms, but also the diversity of their workforces," Ohanian told CBS This Morning.

The changes come as Black Lives Matter protests continue across the US and the globe, with people demonstrating against the recent deaths of George Floyd, Breonna Taylor and Ahmaud Arbery, and against systemic racism.
Rupert Murdoch's New York Post and Fox News are problematic. For years they've promote white nationalism and ridiculed Black athletes, entertainers and politicians.
You got to remember the Australian cartoonist who worked for The New York Post. He drew up that offensive comic portraying Serena Williams as a big fat crybaby while the white tennis star was being egged on to lose the match. The cartoonist was unaware he was insulting two women of color.

Williams and her opponent Naomi Osaka had the match at the 2018 U.S. Open. Osaka is a woman of Asian and Black decent. Her mother is Japanese and her father is Haitian American. Osaka lives in the United States but plays for Japan.
