The Supreme Court proves to be a worthless body of government. It ruled against the safety measures imposed by New York state governor Andrew Cuomo.
The decision of Roman Catholic Diocese of Brooklyn v. Cuomo (2020) ruled in favor of the diocese.
The New York governor was handed a loss. The Court ruled against the restrictions he imposed.
Cuomo was reimposing a strict attendance cap at worship services in areas hit hard by the coronavirus.
The Court’s 5-4 decision bars Cuomo from enforcing the “Cluster Initiative” against houses of worship that sued to challenge the restrictions.
The third pick for the Court appointed by Trump sided as expected with the conservative wing.
Amy Coney Barrett, who was rushed through the Senate despite having little experience in federal court sided with Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Clarence Thomas.
Chief Justice John Roberts sided with the progressive wing’s Elena Kagan, Sonia Sotomayor and Stephen Breyer.
Cuomo said that parts of his state are in the “red zone.” He said that under his authority as governor he had the right to limit attendance to places of worship and places where large gatherings are expected. The Court said that his limits violate the First Amendment’s protection of the free exercise of religion.

Science should trump religion. But since we live with folks believing in mythical creatures and magical beings who turn water into wine, I guess the Court is willing to put your life in danger for your right to sit in a place of worship.
Neil Gorsuch, another inexperienced federal judge appointed to the Court by Trump basically admitted that “religion will cure the coronavirus.”
“It is time -- past time -- to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopens liquor stores and bike shops but shutter churches, synagogues and mosques. So at least according to the Governor, it may be unsafe to go to church, but it is always fine to pick up another bottle of wine, shop for a new bike, or spend the afternoon exploring your distal points and meridians,” said Gorsuch. “Who knew public health would so perfectly align with secular convenience?”
The ruling is seen as reversal from earlier actions taken during the pandemic. The justices before Coney Barrett joined sided with the states.
Roberts said that safety and a public emergency is within the governor’s right to impose.
“Numerical capacity limits of 10 and 25 people, depending on the applicable zone, do seem duly restrictive. It is not necessary, however for us to rule on that serious and difficult question at this time,” said Roberts. “The governor might reinstate the restrictions. But he also might not. And it is a significant matter to override determinations made by public health officials concerning what is necessary for public safety in the midst of a deadly pandemic. If the governor does reinstate the numerical restrictions the applicants can return to this court, and we could act quickly on their renewed applications.”
