The former president is threatening to sue the House Committee chairman to stop the investigation of the January 6th. He instigated a mob to attack the U.S. Capitol. He was impeached for it. He was banned from social media for it. He is facing legal ramifications due to the insurrection.
President Joe Biden had allowed the Congress to get a hold of the National Archives. The former president is trying to prevent the Congress from getting a hold of his former advisors.
The former president is claiming that he has "executive privilege" and says that Rep. Bennie Thompson (D-MS) and David Ferriero, the archivist are violating their oath of duty.
The filing is claim that "Congress had decided to harass [the former president] and senior members of his administration (among others) by sending an illegal, unfounded, and over-broad records request to the Archivist of the United States."
He attacks Biden for allowing it to happen.
"This self-describing 'sweeping' request is almost limitless in scope and effectively seeks every presidential record and communication that could tenuously relate to events that occurred on January 6, 2001. The request also seeks records with no reasonable connection to the events of that day. In a political ploy to accommodate his partisan allies, President Biden has refused to assert executive privilege over numerous clearly privileged documents requested by the Committee," the former president said. "The Committee's request amounts to nothing less than a vexatious illegal fishing expedition openly endorsed by Biden and designed to unconstitutionally investigate [the former president] and his administration. Our laws do not permit such an impulsive, egregious action against a former president and his close advisors."
This doesn't really have any legal standing. I believe a former president has executive privilege but not unlimited powers once out of office. It only applies to a president currently in power. The office of a president is not unlimited power but it is endless powers. A former president does not have the power to make decision when he's not in office.
The former president can delay as long as he can, but it's pretty much a cut and dry situation.
